Introduction
Trusty Finance Pty Ltd ACN 659 716 962 (“we”/“us”/“our”) endeavour at all times to comply with the Privacy Act 1988 (Cth), the Australian Privacy Principles and the Privacy (Credit Reporting) Code 2014 (together, “Australian Privacy Law”).
This Credit Information Privacy Policy is in addition to our General Privacy Policy. It applies to you if you:
- apply to us for one of our credit products;
- receive credit from us; or
- we otherwise hold credit information about you or information about your eligibility for credit or credit worthiness.
What kinds of credit information do we collect, hold, use and disclose?
In addition to the categories in our General Privacy Policy, if you apply for credit from us we may collect and/or disclose:
- Identification information: names; date of birth; contact details; identification documents (e.g. driver’s licence, passport)
- Financial information: income (including government benefits), employment status/history; assets; expenses
- Consumer credit liability information: for each account (with us or another provider): account type; open/close dates; approved credit limit; account terms
- Repayment history information: whether payments were made when due; any late payments; when payment was ultimately made
- Financial hardship information
- Credit application information: type and amount of credit sought; whether we requested information from a Credit Reporting Body
- Default information: where a payment remains overdue by more than 60 days after giving you notice as required by the Australian Privacy Laws, we may disclose to a Credit Reporting Body
- Payment information: showing overdue payments to us or another provider
- Court proceedings information: judgment of any Australian court that was made against you in relation to any credit that was provided to or applied for by you
- Personal insolvency information: recorded in the National Personal Insolvency Index
- Publicly available information: relevant to your credit worthiness
- Serious credit infringement information: which relates to Consumer credit which we or some other credit provider has provided to you to the effect that you:
- fraudulently obtained Consumer credit;
- fraudulently evaded payments under a Consumer credit contract;
- are not able to be contacted at the last known addresses supplied to us or have not been in contact with us for 6 months; or
- are otherwise no longer intending to comply with your Consumer credit obligations.
- Derived credit worthiness or eligibility information: e.g. risk ratings or credit scores (not including your raw financial information)
How do we collect credit information?
We collect credit information:
- directly from you (e.g. application forms);
- from Credit Reporting Bodies;
- from other credit providers;
- by the same means personal information is collected under our General Privacy Policy.
How do we hold your credit information?
We hold and secure credit information in the same way as all personal information (see our General Privacy Policy).
How do we disclose your credit information?
- To obtain reports: we disclose certain credit information to Credit Reporting Bodies, who may include it in reports to other credit providers.
- To other credit providers: at our discretion and with your written consent, excluding raw financial data unless derived.
Notwithstanding that your credit information may be provided to Credit Reporting Bodies, you may request directly to the Credit Reporting Bodies that they do not use or disclose your credit information:
- to a credit provider for the purposes of pre-screening of direct marketing by that credit provider; and/or
- where you believe on reasonable grounds that you have been or are likely to be, a victim of fraud, including identity-related fraud.

The purposes for which we collect, hold, use and disclose your credit information
In addition to the purposes in our General Privacy Policy, we use your credit information to:
- assess your credit application and that of any guarantors;
- manage your credit contract;
- consider any variation of payments (including hardship);
- collect debts or enforce our rights under your contract;
- assist you if at risk of default;
- participate in the credit reporting system and provide information to the above bodies;
- support any sale, transfer or restructure of our business;
- handle complaints through our IDR or EDR processes;
- verify your identity under Anti-Money Laundering/CTF laws;
- meet legal requirements under Australian Privacy Law;
- assist other credit providers, with your consent or if you have committed a serious credit infringement.
We shall not disclose your credit information to any other party for direct marketing, though other personal information may be disclosed as per our General Privacy Policy.
Whether we supply your credit information to overseas recipients
We will not supply your credit information to overseas recipients, except as permitted by Australian Privacy Law.
How you may access or correct your credit information
You may request access to or correction of your credit information by contacting us at:

We will deal with your request according to Australian Privacy Law and provide you our response and/or reasons within 7 business days of making our decision, and no later than 30 days after receiving your request. If we have supplied credit information which we have agreed to correct to a Credit Reporting Body, we will notify that body within 7 business days of making that decision. We cannot give you access to credit information held about you by any Credit Reporting Body. Please refer to their Privacy Policy.
How you may complain
If you are dissatisfied with our handling of your credit information, you may contact our Privacy Officer. If you remain dissatisfied, you may escalate your complaint to:

Changes to this Policy
We may update this policy due to changes in law, technology or our systems. Updates will be notified on our website and, if they affect you and you have a credit contract with us, we will notify you as required.
