Trusty Finance Pty Ltd ACN 659 716 962 (“we”/“us”/“our”), Australian Credit Licence Number 563922, endeavour at all times to comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (“Australian Privacy Law”).

This General Privacy Policy applies to all persons accessing our website, dealing with us or from whom we otherwise collect personal information. We also collect personal and consumer credit information provided by persons applying for or receiving credit from us, complying with the Privacy (Credit Reporting) Code 2014.

All persons who apply for or receive credit from us or guarantee another’s credit are further protected by our Credit Information Privacy Policy.

Any person who receives credit from us and applies to vary payments on hardship grounds is additionally protected by our Hardship Privacy Policy.

Pseudonyms

You are not required to provide your legal name if you wish to remain anonymous. However, we cannot provide consumer credit without obtaining proof of identity—see our Credit Information Privacy Policy for details.

The kinds of personal information we collect

From a website visit we may collect:

  • domain name and IP address
  • date and time of access
  • referring website address
  • pages accessed
  • via cookies/similar tracking, your email address

From dealing further with us (customer, guarantor, contractor, supplier):

  • name, date of birth
  • address history (current & previous, length of residence)
  • phone number(s), email address
  • employer details & employment history
  • identification documents (e.g. driver’s licence, passport)
  • bank account information & transaction history
  • details of any referees you supply

If you apply for consumer credit we also collect consumer credit information (see Credit Information Privacy Policy). If you apply for hardship, you may supply sensitive information under our Hardship Privacy Policy.

How we collect your personal information

  • Website data via cookies/anonymous identifiers (you can block cookies but some features may not work)
  • Directly from you in person, by phone, by mail, via online forms, email or fax
  • From third parties (where reasonable): credit reporting bodies; someone authorised by you (agent, broker, introducer, guarantor); referees; employers; government agencies; other financial institutions; trade associations; our agents

When you supply information about others (e.g. spouse, dependants), you must ensure they have consented and been informed of this policy.

How we hold your personal information

We take all reasonable steps to secure your personal information, including:

  • secure storage (physical and electronic)
  • encrypted third-party software with regular penetration testing
  • restricted access to authorised personnel
  • encryption/password protection of electronic records

When information is no longer needed, we will destroy or de-identify it, subject to legal and regulatory retention requirements.

The purposes for which we collect, hold, use and disclose your personal information

We only use your personal information for purposes:

  • permitted by Australian Privacy Law
  • necessary for administering contracts and providing products
  • considering guarantees or applications for credit
  • assessing job applications or managing our business
  • improving website usability
  • required by law or to enforce our contractual rights
  • investigating complaints under Australian Privacy Law
  • communicating with you (including direct marketing, unless you opt-out)
  • to search and/or register any Personal Property Securities
  • to otherwise communicate with you or for the purposes outlined above

If you apply for or receive consumer credit, we also use your information to:

  • assess and manage your credit application and contract
  • consider payment variations (including hardship)
  • enforce our rights under the contract

We may disclose your personal information to service providers or prospective purchasers only if necessary and in compliance with Australian Privacy Law.

Credit Sense Bank Statements Service

We use the services of Credit Sense Australia Pty Ltd (ABN: 96 163 577 768) to retrieve read-only bank statements that help assess us your suitability for a loan. These statements may be stored for managing your credit and evaluating future applications. Credit Sense may use or disclose transaction data only in de-identified form. You may review their terms and privacy policy at https://www.creditsense.com.au/. When you enter your banking login credentials into the Credit Sense platform, your details are immediately encrypted and stored securely by Credit Sense. By providing this information, you grant ongoing authorization for us to assess and manage your credit, including hardship variations, enforcement action, or refinancing. You may terminate this authorisation by contacting Credit Sense.

Whether we supply your personal information to overseas recipients

We do not intend to disclose personal information overseas, though secure “cloud” backups may be located overseas. We will not permit access by overseas persons except as required by law.

Electronic Communications

If you apply for consumer credit with us, you understand and acknowledge that you give consent to electronic communications and that:

  • paper-based documents may no longer be given
  • electronic communications must be regularly checked for documents
  • consent to electronic communications may be withdrawn at any time

By applying, you authorise us to send notices and documents (Credit Guides, credit contracts, variations and other legal notices) electronically under the Electronic Transactions Act 1999 and the National Consumer Credit Protection Act 2009, and to act on instructions you send electronically (e.g. email to the address you provide or any other method permitted by law).

How you may access or correct your personal information

If we are unable to grant access, we will provide reasons in writing within a reasonable time. These may include where providing the information may:

  • reveal personal information about another individual
